Policies and Conditions
You must be 18 years of age to join online
Your privacy is our concern. We have taken precautions to protect the privacy of you personal information with this online registration for membership. We are not liable for any leak or misuse of personal information that results from online payments and registration with Ultimate Fitness
30 Day cancellation notice:
To cancel your EFT transactions you must give a full 30 day written notice by certified mail sent to: Ultimate Fitness, 1910 Geneva Street, Sioux City, IA 51103. Verbal notification, faxes and/or emails will not be accepted.
Membership eligibility ages:
Children 14-17 may workout without a parent or guardian during staffed hours only
Any member under 18 years of age must be accompanied by a parent or guardian after hours
No person under the age of 8 is allowed in the facility at any time unless approved by management
Tanning:
Tanning may be used during staffed hours only
Tanning packages are not to be shared
Goggles mandatory by Iowa state law
Maximum exposure time is 10 minutes
Tanning is allowed once every 24 hours
No use of lotions bought elsewhere unless approved by management
Minimum age to tan is 14 years
Personal Training:
Two free sessions are complimentary with monthly EFT memberships only
One month members receive one free “orientation” upon availability of staff
No refund or credit is given for complimentary sessions not used
EFT Payment due date:
All EFT payments from credit/debit cards, checking or savings accounts are due the 1st day of each month.
All returned credit/debit card, checking or savings account funds will be electronically resubmitted within 3-10 business days along with a $25 service charge. All access keys/codes will be inactive until payment is received.
Holds/Freezes on your membership may be put on your EFT membership for up to 60 days upon approval of management
General Rules:
Every member must pay 24-hour access initiation fee and each have an access code/key of their own
You must use your own access key/code to enter the facility, if your key/code is lost you must purchase a replacement
You may bring in guests during staffed hours only: a guest fee will be charged at the time of service
Lockers are provided for daily use, any locks left on lockers for more than 2 day will be removed by management
Street shoes are not allowed on workout floor at any time
Proper attire must be worn when working out: ie tennis shoes, shorts, sweat suits and t-shirts ( no jeans, boots, cutoffs or swimsuits allowed)
Non-use of the facility does not entitle you to any refund or credit for your membership term
Your monthly EFT membership payments will continue to accrue if for any reason we are unable to collect funds from your credit/debit card, checking or savings account. Your membership will not be cancelled due to non-payment until we receive a 30 day written notice by certified or registered mail or you come into the facility to sign the proper cancellation forms. Any past due accounts will be subject to collection procedures.
Absolutely no use of the free-weight bench press after hours
Household addition rules:
Must be a spouse or significant other that lives in the same household as the main account holder
Must be a child age 8-19 that lives in the same household as the main account holder
NO ROOM MATES
NO FAMILY MEMBERS THAT DO NOT LIVE IN THE SAME HOUSEHOLD AS THE MAIN ACCOUNT HOLDER
Couple/Family memberships are reserved for 2 adults and a max of 4 children between the ages of 8 and 19.
24-hour access Rules:
Do not allow anyone into the facility with you at any time for any reason. This includes spouses, children, family or friends. Children under the age of 8 are not allowed in the facility at any time (unless checked into daycare).
If I have a balance on my account my key/code will be inactive until payment is received.
Ultimate Fitness will not be liable for any injuries, loss of theft of personal items during staffed and un-staffed hours.
Memberships are non-transferable and non-refundable. Any members sharing access keys/codes or bringing in other non-members with them during staffed or un-staffed hour will be charged $75 per occurrence and per person for the violation.
Ultimate Fitness has the right to refuse service to or discontinue/cancel memberships at their discretion for any person or member with no refund of any payments made.
Waiver:
In consideration for membership at Ultimate Fitness, I hereby, for myself, and heirs, personal representatives, and administrators, waive and release all rights and claims for damages I may have against Ultimate Fitness and its representatives, successors, and assigns for any and all injuries which may be suffered by me in connection with any participation in all programs. Membership rates are subject to change upon a 30 day notice to member. Non-usage does not exclude you from monthly dues payment.
BUYERS RIGHT TO CANCEL
Transaction Date: date of payment online
You may cancel this transaction within three business days from above date.
If you cancel, any payments made by you under the contract, less twenty dollars, and any negotiable instrument executed by you will be returned within forty-five days following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be cancelled. After you cancel, the physical exercise club may request the return of all contracts, membership cards, and other documents or evidence of membership.
To cancel this transaction, send, or deliver a signed and dated copy of this cancellation notice or any other written notice by certified mail to Ultimate Fitness at 1910 Geneva Street, Sioux City, Iowa 51103 not later than midnight of: three days from Transaction Date.
